Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

Cooling-off period:

The period in which the consumer can exercise the right of withdrawal.

Consumer:

The natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

Day:

Calendar day.

Duration transaction:

A distance contract relating to a series of products and/or services where the delivery or acceptance obligation is spread over time.

Durable data carrier:

Any means that allows the consumer or entrepreneur to store information addressed to them personally in a way that enables future consultation and unaltered reproduction.

Right of withdrawal:

The option for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur:

The natural or legal person who offers products and/or services remotely to consumers.

Distance contract:

A contract concluded as part of a system organized by the entrepreneur for the remote sale of products and/or services, where up to and including the conclusion of the contract only techniques for distance communication are used.

Technique for distance communication:

Means that can be used to conclude a contract without the consumer and entrepreneur being present at the same time.

Article 3 – Applicability

These General Terms and Conditions apply to every offer by the entrepreneur and to every distance contract and order between the entrepreneur and the consumer.

Before the distance contract is concluded, the consumer will receive access to the text of these Terms and Conditions. If this is not reasonably possible, the entrepreneur will indicate where the Terms and Conditions can be viewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, the Terms and Conditions may be provided electronically in a format that the consumer can store on a durable data carrier.

Where specific product or service conditions apply in addition to these Terms and Conditions, the consumer may rely on the provision most favorable to them in case of discrepancies.

If any provision is wholly or partially void or annulled, the remaining provisions remain fully applicable. The invalid provision will be replaced by one that aligns as closely as possible with the original intent.

Situations not covered by these Terms and Conditions will be assessed in accordance with their spirit and purpose.

Ambiguities regarding the interpretation of one or more provisions must likewise be interpreted according to the spirit of these Terms and Conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to specific conditions, this will be explicitly stated.

The offer is non-binding; the entrepreneur may adjust or modify it at any time.

The offer includes a complete and accurate description of the products and/or services offered. Images are intended to represent the products truthfully. Obvious mistakes or errors do not bind the entrepreneur.

All images, specifications, and descriptions in the offer are indicative and cannot be the basis for compensation or termination of the contract.

Each offer provides sufficient information to clarify the rights and obligations associated with acceptance, including pricing (including taxes), shipping costs, withdrawal rights, payment and delivery methods, the validity period of the offer, and any applicable communication costs.


Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets all associated conditions.

If acceptance is submitted electronically, the entrepreneur immediately confirms receipt. Until this confirmation is received, the consumer may cancel the contract.

The entrepreneur ensures proper technical and organizational measures to secure electronic data transmission.

The entrepreneur may verify whether a consumer can meet their payment obligations. If justified, the entrepreneur may refuse or attach conditions to an order.

Upon conclusion of the contract, the entrepreneur provides the consumer with:

  • the visiting address for complaints
  • terms for exercising the right of withdrawal
  • warranty information
  • and any additional contractual conditions

Contracts are subject to product availability.


Article 6 – Right of Withdrawal

Consumers may withdraw from a purchase within 14 days without providing a reason. The cooling-off period begins the day after the consumer receives the product.

During this period, consumers must handle the product and packaging with care. If they exercise their right of withdrawal, the product must be returned in its original condition, including accessories and packaging.

The consumer must notify the entrepreneur of their decision to withdraw within 14 days and must provide proof of timely return.

If the consumer does not withdraw or return the product within the time limits, the purchase becomes final.


Article 7 – Costs of Withdrawal

If the consumer exercises the right of withdrawal, the return shipping costs are borne by the consumer.

Any payments made by the consumer will be refunded within 14 days after withdrawal, provided the return is received or proof of return is provided.


Article 8 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude withdrawal rights for certain products or services if clearly stated, such as:

  • custom-made or personalized products,
  • products unsuitable for return for hygiene reasons,
  • perishable goods,
  • sealed audio/video/software after opening,
  • financial market-dependent prices,
  • newspapers and magazines,
  • leisure services tied to a specific date.

Article 9 – Price

Prices stated in the offer are fixed during the validity period, except for changes in VAT or market-based fluctuations mentioned in the offer.

Price increases within 3 months of contract conclusion are only allowed due to legal requirements.

All prices include VAT.

Obvious pricing errors do not bind the entrepreneur.


Article 10 – Conformity and Guarantee

Products and services must meet the terms of the contract, reasonable quality and usability expectations, and applicable legal standards.

Guarantees do not affect statutory consumer rights.

Guarantees do not apply if damage is caused by misuse, improper handling, or unauthorized modifications.


Article 11 – Delivery and Execution

The entrepreneur takes utmost care in processing orders and delivering products.

Delivery takes place at the address provided by the consumer.

If delivery is delayed or cannot be fulfilled, the consumer will be notified as soon as possible and may cancel the contract. Any payments will be refunded.

The risk of damage or loss remains with the entrepreneur until delivery.


Article 12 – Duration Transactions

Consumers may terminate indefinite duration agreements with a notice period of up to one month.

Fixed-term agreements may be terminated at the end of the agreed period unless automatically extended under the applicable rules.

Agreements of more than one year may be terminated after one year with one month’s notice.


Article 13 – Payment

Payments must be made within 7 days of the cooling-off period unless otherwise agreed.

Consumers must notify the entrepreneur of any incorrect payment details.

If a consumer fails to fulfill payment obligations, reasonable costs may be charged.


Article 14 – Complaints Procedure

Complaints must be submitted within a reasonable time, preferably within 7 days after discovering a defect.

The entrepreneur responds within 14 days.

Valid complaints may lead to replacement, repair, or other appropriate solutions at no cost to the consumer.


Article 15 – Disputes

All contracts between the entrepreneur and the consumer are governed by Dutch law, even if the consumer resides abroad.
